1. Acceptance of Terms

Welcome to Nox Social ("we," "our," or "us"). By accessing or using the Nox Social mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

2. Eligibility

2.1 Age Requirement

By creating an account, you represent and warrant that:

• You are at least 21 years of age
• You have the legal capacity to enter into these Terms
• You will provide accurate date of birth information

We reserve the right to request proof of age at any time. Accounts of users found to be under 21 will be terminated immediately without notice.

2.2 Geographic Restrictions

The App is currently available only in the United States. By using the App, you represent that you are located in the U.S. or are visiting temporarily.

2.3 Account Registration

You must create an account to use certain features. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Not share your account with others
• Notify us immediately of any unauthorized use

You are responsible for all activity on your account.

3. Acceptable Use

3.1 Permitted Uses

You may use Nox Social to:

• Discover nightlife venues and events
• Connect with friends and other users
• Share photos and videos from nightlife experiences
• Participate in challenges and social features
• Purchase event tickets
• Engage with venue communities

3.2 Prohibited Conduct

You agree NOT to:

Illegal Activity:

• Violate any local, state, federal, or international law
• Promote or facilitate illegal drug use
• Share content depicting illegal activity
• Purchase or sell illegal items or services

Harassment and Abuse:

• Harass, bully, stalk, or intimidate other users
• Send unsolicited sexual content or messages
• Impersonate another person or entity
• Engage in hate speech or discrimination

Content Violations:

• Post pornographic or sexually explicit content
• Post graphic violence or gore
• Share content you don't have the rights to
• Infringe on intellectual property rights
• Post spam or misleading information

Platform Abuse:

• Create fake accounts or bot accounts
• Use automated systems to access the App
• Attempt to hack, breach, or bypass security measures
• Reverse engineer or decompile the App
• Scrape or harvest user data

4. User Content

4.1 Your Content

You retain ownership of content you post ("User Content"), including:

• Photos and videos
• Comments and messages
• Reviews and ratings
• Profile information

4.2 License to Nox Social

By posting User Content, you grant Nox Social a:

• Worldwide, non-exclusive, royalty-free, sublicensable, transferable license
• To use, reproduce, distribute, display, and modify your User Content
• For the purposes of operating, promoting, and improving the App

This license ends when you delete your content or account, except:

• Content shared by other users (e.g., if someone saved your photo)
• Content needed for legal compliance or safety reasons

4.3 Copyright and DMCA

We respect intellectual property rights. If you believe content on Nox Social infringes your copyright:

5. Ticket Purchases and Events

5.1 Ticket Sales

When purchasing tickets through Nox Social:

• Tickets are sold by the venue or event organizer, not by Nox Social
• We act as a platform to facilitate ticket sales
• Prices, availability, and terms are set by the venue
• All sales are final unless otherwise stated by the venue

5.2 Refunds

Refund policies are set by the venue or event organizer. Contact the venue directly for refund requests. Nox Social does not issue refunds for tickets purchased through the App, except:

• If an event is cancelled by the organizer
• If required by law

6. Account Termination

6.1 Termination by You

You may delete your account at any time in app settings. Upon deletion:

• Your profile and User Content will be removed within 30 days
• You will lose access to all account features
• Ticket purchases and transactions are not affected

6.2 Termination by Us

We may suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Illegal activity
• Fraud or abuse
• Inactivity (accounts inactive for 2+ years)
• Risk to our users or the platform
• Any reason or no reason

7. Privacy

Your use of the App is governed by our Privacy Policy, available at nox.social/privacy.

By using Nox Social, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.

8. Disclaimers and Limitations of Liability

8.1 "AS IS" Disclaimer

We disclaim all warranties, including:

• Merchantability, fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security or absence of viruses

8.2 Limitation of Liability

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruptions or data loss
• Actions of other users or third parties

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF:

• $100, or
• The amount you paid to Nox Social in the 12 months before the claim

9. Dispute Resolution

9.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@nox.social and attempt to resolve the dispute informally for at least 30 days.

9.2 Arbitration Agreement

By agreeing to these Terms, you waive your right to:

• Go to court
• Have a jury trial
• Participate in a class action lawsuit

Arbitration Rules:

• Governed by the Federal Arbitration Act
• Conducted by the American Arbitration Association (AAA)
• Each party pays their own costs and fees
• For claims under $10,000, we will reimburse your arbitration fees if you prevail

9.3 Class Action Waiver

You may not:

• Participate in a class, consolidated, or representative action
• Act as a class representative or private attorney general
• Combine your claim with others

10. General Provisions

10.1 Modifications

We may update these Terms at any time. When we do:

• We will update the "Last Updated" date
• For material changes, we will notify you via email or in-app notification
• Your continued use after changes constitutes acceptance

10.2 Contact Us
